Legal axiology

The legal axiology deals with the problem of legal values, that is, it elucidates the values that will make a model of law correct or that will take precedence when developing or applying the law. Of all the values of law, the most important is that of justice; It is so important that some authors refer to legal axiology as Theory of Justice.

The word axiology comes from the French. axiologie, and this from the gr. ἄξιος áxios 'worthy', 'that has value' and the fr. -logie '-logie'.. whose meaning can be translated as 'study' 'or 'theory'.

Several philosophers of law call axiology as the theory of values or also known as legal deontology (what law should be), for this reason legal axiology is part of legal philosophy.

Legal axiology has a link with all social ordering because it is based and starts with the declaration of rights, on the principles of legal guarantees (which we can identify 3 legal guarantees, due process, effective protection, and security legal).
