In addition to suing The Sun, Depp also sued Heard for defamation in Virginia in early 2019 over an op-ed on abusive relationships, published by The Washington Post in December 2018. Depp alleged that Heard had been the abuser, that her allegations were untrue, and that Disney had as a result declined their involvement in future projects. Heard countersued Depp in August 2020., alleging that he had coordinated "a campaign of harassment via Twitter and [by] orchestrating online petitions in an effort to get him fired from Aquaman and L'Oréal." In October 2020, the judge in the case fired Depp's lawyer, Adam Waldman, after he leaked confidential information under a protective order to the media. Following the verdict in Depp's lawsuit against The Sun the following month, Heard's lawyers asked for the libel suit to be dismissed, but Judge Penny Azcarate ruled against it because Heard had not been sued in the UK case. In August 2021, a New York judge ruled that the ACLU must release documents related to Heard's charity pledge to the organization. Depp's trial against Heard began in Fairfax County, Virginia on April 11. April 2022. Whitney Hernandez, Heard's sister, testified that she had witnessed physical violence by the actor against his wife and herself during the time he had lived with both of them.
