Cooperation in criminal matters
International doctrine recognizes three levels of cooperation in criminal matters:
- Judicial assistance in criminal matters.
- Extradition.
- Transfer of convicts.
It is also important to highlight that the first two levels of cooperation mentioned have a direct impact on the investigation, prosecution and punishment of the crime, but the transfer of convicted persons, in particular, also called execution of criminal sentences, not only implies that the Court of a country recognizes and applies in its own legal system the sentence of another State, but rather pursues the social rehabilitation of the person who has committed a crime, a very important aspect within criminal law, is carried out in optimal conditions, which implies that the person can finish serving the sentence in their country of origin.
This cooperation also makes it possible to rescue those legal or illegal immigrants who, in one way or another, have contravened local laws and have been exposed to receiving a criminal sentence.
The new international legal practice not only encourages the court of a country to recognize the criminal sentence issued by the legal system of another State, but also allows the transfer of a prisoner sentenced to serve a sentence in his country of origin, thus facilitating, as far as possible, their social rehabilitation. in military matters
